However, copyright alone may prove inadequate when designs are commercialised on a mass scale. Under Section 15(2) of the Copyright Act, an artistic work that is also registrable as a design loses protection once reproduced industrially more than 50 times if it is not registered under the Designs Act.

To supplement copyright protection, designers should consider registration under the Designs Act—and also explore trademark and trade dress registration. Elements such as patterns, ornamentation, and distinctive material choices can be protected under design or trademark law. These registrations should be secured before any public disclosure or production, offering layered protection to fashion creations.
